    一、学科、专业简介

    法与经济学科建于2005年,是经教育部批准的具有博士和硕士学位授予权的法学二级学科。2008年法与经济学被评为北京市重点交叉学科。本学科的主要任务,一是运用法与经济学的理论和方法,研究中国的法律现象和法律问题,分析法律对经济、社会、环境的影响,提出改革和完善法律的建议;二是培养具有较高的理论素养、较强的科研能力和实践能力的复合型法与经济学人才。

    本学科现有专职教师10人,其中教授、博士生导师4人,副教授、硕士生导师3人,讲师3人。学科建立以来,已出版学术专著、译著、论文集14部;发表权威期刊及核心期刊论文146篇,学术论文、研究报告被采纳、转载27篇;承担国家社科基金项目、教育部人文社科项目、司法部项目、北京市哲学社会科学规划项目,以及各类横向项目共48项;举办法与经济系列讲座67场;先后参与了10余部法律、法规和规范性文件的起草和修改工作;与美国、英国、意大利、德国、荷兰等国家的知名院校以及欧盟委员会等组织建立了密切的学术交流关系。法与经济学专业于2005年开始招生,已招收博士研究生29人,硕士研究生113人,已毕业十届研究生。法与经济学专业与意大利博洛尼亚大学、荷兰鹿特丹伊拉斯谟大学等开展了联合培养研究生项目。

    二、培养目标

        法与经济学专业的总体培养目标是,培养具有扎实的理论基础和专业知识,能够独立从事法与经济学专业领域科研与实务工作的具有国际视野的复合型人才。

    具体要求是:

        (一)硕士研究生具有创新思维,能够在法与经济学领域做出有创新价值的科研成果。

        (二)硕士研究生系统掌握法与经济学的基本理论与方法,并能用来解决我国经济和社会发展中的理论与实践问题。

        (三)硕士研究生具有国际视野,了解国外法与经济学的最新进展,能够熟练地掌握和运用一门外国语进行法与经济学的研究与学术交流。

        (四)具有健康的身心素质。

    三、研究方向

         本专业设四个研究方向:

        (一)法律的经济分析:主要探讨法与经济学的基本理论问题。

        (二)转型经济与转型法律:主要运用法和经济学的分析方法,在转型的语境下,研究经济转型和法律转型之间的关系。

        (三)法律与金融监管:主要运用法和经济学的分析方法,探讨法律和金融之间的关系,揭示法律在金融发展中的作用。

        (四)市场与监管:主要运用法和经济学的分析方法,探讨市场失灵与政府监管的关系,主要探讨监管什么、如何监管、监管的成本与监管的收益。

    六、培养方式

    (一)实行导师集体辅导与导师负责制相结合的方式。

    (二)学位专业课采取课堂讲授与讨论相结合的方式。选修课以教师讲授为主。

    (三)本专业以法与经济学系列讲座作为硕士研究生培养的重要方式之一。

    (四)本专业定期选派优秀研究生赴国外著名院校联合培养或攻读硕士学位。

    、质量标准

    (一)硕士研究生养成独立思考和创造性思维的能力,在本专业领域内能够做出有创新性的科研成果。

    (二)硕士研究生能够运用法与经济学的理论与方法,研究解决社会主义市场经济建设和法治建设中的理论与实践问题。

    (三)硕士研究生具有国际视野,了解国外法与经济学的最新进展,能够熟练地掌握和运用一门外国语进行法与经济学的研究与学术交流。

    八、考核方式

    本专业按国家教育部和本校的有关规定考核。考核方式为面试、论文、答辩等。中期考核在第三学期末完成。

    九、学位论文选题与撰写

    (一)学位论文应导师指导下独立完成。

    (二)本专业研究生可以自主选择本专业范围内的前沿问题和有重要价值的选题。

    (三)研究生学位论文应当进行开题报告,经评审通过后方可进入论文写作阶段。开题报告通过后,一般不得随意改题。

    (四)本专业研究生学位论文开题后,实行教师访谈制度。

    (五)学位论文严禁抄袭剽窃。研究生发生学术不端行为的,导师应承担相应责任。

    (六)学位论文必须符合规定的要求和格式,论文字数要求达到3万字。

    十、学位论文答辩与学位授予

    (一)本专业实行预答辩制度,不参加预答辩者不能参加答辩。因特殊情况或获准提前或延期毕业的研究生不能参加本专业本年级预答辩的,可以补预答辩程序,但预答辩和答辩的时间间隔应不少于3个月。

    (二)论文的原创性检查、评审、导师回避等按照学校有关规定进行。

    (三)本专业按规定组成答辩委员会,对申请人进行答辩和表决,并向校学位评定委员会提出授予或不授予硕士学位的建议。

    1.文献阅读与综述

    (导师考核)

        硕士研究生第1至第4学期,每学期精读专著不少于2本,具体书目由导师指定,可以通过读书报告或书评形式考核。

    硕士研究生所修学分不低于6学分。其中,文献阅读与综述、科研环节的学分必须修得。

    2.科研环节

    (导师考核)

        硕士研究生第1至第4学期,每学期应提交学期论文1篇,共4篇。其中,第一、三学期的学期论文可以以读书报告形式提交。每篇学期论文不少于5000字,读书报告不少于3000字。

        应届硕士研究生必修。

    可以通过专业实习、挂职锻炼、产学研基地联合培养和社会调查等方式进行。以专业实习为主。时间不少于2个月。

         选修法学院开设的“法律诊所”课程获得的学分可以充当实践学分。
